الملخص

يحتاج اي بناء تشريعي الى قواعد عدالة واضحة (وقائية وعلاجية) تترجم الاخلاق الفاضلة تجسد كرامة الانسان وانسجامه مع الانسان الآخر او مع المجتمع, ويحتاج الى كفاءة متخصصة في رسم السياسة التشريعية في المجتمعات المعقدة. وان توفر قواعد الحد الاقصى من النفع لأجل الفئات الضعيفة في اوقات الازمات. ويمكن معالجة الاضرار التي لحقت المكون الايزيدي بسبب الارهاب من خلال العدالة الانتقالية والتضامن والتماسك الوطني. وقد نص دستور العراق الدائم لسنة 2005 على عدد من مظاهر العدالة الانتقالية, ولكن لم ينص على التضامن ولا سيما بين الاقاليم بشكل صريح, لكن نص في عدد من المواضع على الوحدة الوطنية.

اضعف الدستور العراقي من قيمة العدالة عندما لم يرسم قيود محددة لأنواع الجرائم التي يخصها العفو العام. ولم يستبعد قانون الناجيات الايزيديات رقم (8) لسنـة ٢٠٢١ الابادة الجماعية والجرائم المناهضة للإنسانية من العفو , وانما استبعد جريمة الخطف والسبي فقط. ومع ذلك ان مظاهر التمكين القانوني للمكون الايزيدي في الحياة الاجتماعية كانت متنوعة, لكن من حيث الحياة السياسية اضعف المشرع العراقي من تمثيل المكونات داخل المجالس النيابية والتنظيمات الحزبية قانوناً.
