ان المحافظة على الاسرار يعكس مدى الثقة التي اودعها صاحب السر بمن اودع لديه، وان افشاء هذه الاسرار تعتبر من الاعمال الممقوته والمشينة التي تجعل من صاحبها محل ازدراء وسخرية وعدم احترام وغير جدير بالثقة من قبل الاخرين ، ومن هذا المنطلق وحفاظا على الاسرار المهنية لصاحب العمل( صاحب السر) اوجب المشرع على العامل والزمه بضرورة المحافظة على هذه الاسرار التي تصل الى علمه بحكم مهنته وعمله ،وادراكا منه بخطورة هذا الفعل على الحقوق الشخصية لصاحب العمل بالإضافة الى خطورته على الاعمال التجارية ومن شانه تعريض صاحب العمل الى اضرار جسيمة لذلك جرم المشرع هذا السلوك المتمثل بافشاء اسرار المهنة لما لها من تاثيرا واضرار كبيرة على صاحب العمل وعلى الاعمال والمشاريع التجارية مستقبلا.
