الملخص

يركز هذا البحث على تحليل مدى امتثال العراق لالتزاماته الدولية المتعلقة بالتحقيق والمحاكمة عن جريمة الإبادة الجماعية، ولا سيما في سياق الجرائم التي ارتكبها تنظيم داعش الارهابي ضد جماعات متعددة داخل العراق. وانطلاقًا من التوصيفات الصادرة عن الأمم المتحدة والهيئات الدولية المستقلة، والتي أكدت أن بعض الانتهاكات التي تعرّض لها الإيزيديون والمسيحيون والشيعة ترقى إلى جريمة الإبادة الجماعية، يدرس البحث ما إذا كان اكتفاء العراق بمحاكمة مرتكبي هذه الأفعال على أساس "جريمة الإرهاب" بموجب قانون مكافحة الإرهاب رقم 13 لسنة 2005 يُعدّ إخلالاً بالتزاماته بموجب اتفاقية منع جريمة الإبادة الجماعية لعام 1948 والقانون الدولي العرفي. يعتمد البحث على تحليل قانوني مقارن يبيّن أن الالتزام بالمقاضاة على الإبادة الجماعية هو التزام محدد قائم بذاته، ولا يمكن الوفاء به من خلال تكييف الجرائم تكييفًا مختلفًا، حتى وإن كان أقلّ وصفًا من حيث الخطورة. كما يناقش البحث معايير "الوفاء الكافي" التي أرستها محكمة العدل الدولية، والتي تُلزم الدول بمحاكمة الإبادة بوصفها كذلك كلما توافرت أدلتها. ويخلص البحث إلى أن الاقتصار على محاكمات الإرهاب، رغم أهميتها، قد يشكل انتهاكًا للالتزامات الدولية للعراق، ولا ينسجم مع حقوق الضحايا ولا مع الطبيعة الخاصة لجريمة الإبادة الجماعية.
