الملخص

جريمة الإبادة الجماعية تُعتبر واحدة من أخطر التهديدات التي تواجه النظام القانوني الدولي، إلى جانب تأثيرها السلبي على السلام والأمن العالميين. منذ أن تم اعتماد اتفاقية منع ومعاقبة جريمة الإبادة الجماعية عام 1948، بذل المجتمع الدولي جهودًا مكثفة لوضع إطار قانوني يضمن معاقبة مرتكبي هذه الجريمة ويسعى إلى عدم تكرارها. وفي هذا السياق، جاء تأسيس المحكمة الجنائية الدولية وفق نظام روما الأساسي لعام 1998 كخطوة حاسمة في تطوير القانون الجنائي الدولي، حيث ساهمت المحكمة في توضيح العناصر الأساسية لجريمة الإبادة الجماعية، وتحديد معايير الإثبات، وحدود المسؤولية الجنائية الفردية. تهدف هذه الدراسة إلى تناول إسهامات المحكمة الجنائية الدولية عبر تحليل القضايا الرئيسية، مثل ما حدث في دارفور وميانمار، وما نتج عن ذلك من تأثيرات قانونية وقضائية أسهمت في تطور فهم ودراسة قانون الإبادة الجماعية. كما تسلط الضوء على التحديات القانونية والسياسية التي تعيق عمل المحكمة في التصدي لهذه الجريمة. وتشمل هذه التحديات مسائل تتعلق بصعوبة جمع الأدلة، نقص التعاون الدولي، بالإضافة إلى غياب الإرادة السياسية لدى الدول. من خلال اعتماد منهجية تحليلية مقارنة، تهدف الدراسة إلى تقديم توصيات من شأنها تعزيز دور المحكمة الجنائية الدولية في الوقاية من جريمة الإبادة الجماعية، وتدعيم جهود تحقيق العدالة الدولية وصون كرامة الإنسان.
