الملخص

تعرضت الأقلية الإيزيدية في العراق لواحدة من أبشع الجرائم في التاريخ الحديث، إثر الهجوم الذي شنته جماعات إرهابية مسلحة في عام 2014، والتي ارتُكبت خلاله أفعال ترقى إلى جريمة الإبادة الجماعية وفقاً لـ اتفاقية منع جريمة الإبادة الجماعية والمعاقبة عليها لعام 1948. وقد شملت هذه الجرائم القتل المنهجي، والاستعباد، والتهجير القسري، والعنف الجنسي، لا سيما ضد النساء والأطفال.

تبحث هذه الدراسة في الإطار القانوني الدولي لجريمة الإبادة الجماعية وأركانها، مع تحليل مدى انطباقها على الجرائم المرتكبة ضد الإيزيديين، وتسليط الضوء على تحديات إثبات الركن المعنوي والقصد الخاص لدى الجناة. كما تستعرض الدراسة الممارسات القضائية على الصعيدين الوطني والدولي، بما في ذلك المحاكمات التي جرت في العراق—والتي غالباً ما استندت إلى تهم الإرهاب—مقارنة بالمحاكمات في بعض الدول الأوروبية التي كيّفت هذه الأفعال صراحةً بوصفها "إبادة جماعية". تهدف الدراسة إلى تقييم الفجوة بين النص القانوني والتطبيق العملي، وطرح حلول لتعزيز العدالة الجنائية الدولية وضمان عدم إفلات مرتكبي هذه الجرائم من العقاب.
