الملخص

يتناول هذا البحث جريمة الإبادة الجماعية من منظور قانوني وإنساني، مسلطًا الضوء على الجرائم التي ارتكبها تنظيم داعش الإرهابي بحق المكون الإيزيدي في العراق منذ عام 2014، فقد مثّلت هذه الجرائم ـ بما تضمنته من قتل جماعي، واسترقاق جنسي، وتهجير قسري ـ أوضح تطبيق لمفهوم الإبادة الجماعية كما نصت عليه اتفاقية منع ومعاقبة جريمة الإبادة الجماعية لعام 1948.

يسعى البحث إلى تحليل الإطار القانوني الدولي الذي يُعرّف ويُجرّم هذه الجريمة، وبيان مدى انطباقها على الحالة الإيزيدية، مع التركيز على معاناة الضحايا بوصفهم محور العدالة الجنائية الدولية، كما يناقش البحث آليات المساءلة المتاحة، سواء عبر المحكمة الجنائية الدولية، أو المحاكم الخاصة، أو الاختصاص العالمي الذي تبنته بعض المحاكم الوطنية (مثل القضاء الألماني).

وتتطرق الدراسة إلى أبرز التحديات التي تواجه المساءلة، كغياب التشريعات الوطنية الكافية في العراق، وعدم انضمام الدولة إلى نظام روما الأساسي، وصعوبات جمع الأدلة وحماية الشهود. وفي الختام، تقدم الدراسة توصيات عملية لتعزيز المساءلة، من خلال تبني تشريعات وطنية متوافقة مع القانون الدولي، وتطوير آليات العدالة الانتقالية التي تضمن تعويض الضحايا ومنع تكرار الجرائم
